Después de la reforma electoral estatal oaxaqueña de 1995, cuando el 72% de los municipios votó por el sistema de usos y costumbres, se demostró que esta modalidad se encontraba plenamente vigente. Fue así como Teresa Valdivia Dounce se interesó en conocer cuáles habín sido los factores que incidieron para mantener con vigencia este uso. La autora realizó su investigación en catorce municipios de las regiones alta y media de la sierra mixe, en el estado de Oaxaca, donde hizo un minucioso examen de las estructuras y formas de gobierno indígena, así como de las formas para elegir a sus autoridades y observar el cumplimiento de sus normas jurídicas. Teresa Valdivia nos muestra así la complejidad de los sistemas jurídicos mixes mal llamados "usos y costumbres" ya que la forma de elección de sus autoridades es sólo una de las normas comprendidas en su sistema jurídico o de derecho, el cual ha sobrevivido gracias a varios factores que desarrolla en su obra.

El presente estudio aborda una importante cantidad de datos y una síntesis general de los principales resultados de su investigación sobre el complejo arqueológico de Cacaxtla-Xochitecatl-Nativitas en Tlaxcala. El estudio vincula los datos del proyecto con el desarrollo general de la sociedad prehispánica de la región Puebla-Tlaxcala y de otras partes de Mesoamérica. Los resultados del proyecto dan cuenta de la cronología, cerámica, del impacto de las grandes erupciones volcánicas, de la importancia de la agricultura de chinampas, del patrón de asentamiento de la comunidad y de la región, del desarrollo socio-político y del intercambio económico local e interregional.

Los estados antiguos tenían sus raíces en la agricultura, el sedentarismo y el crecimiento de la población. Eran frágiles y propensos al colapso, pero no hay consenso sobre las causas o el significado del colapso en este tipo de sociedades. Las explicaciones del colapso en términos de los factores monocausales en competencia se consideran inferiores a las que incorporan sistemas dinámicos e interactivos. Se propone que el colapso debe explicarse como el incumplimiento de las funciones centrales del antiguo estado: aseguramiento del suministro de alimentos, defensa contra ataques externos, mantenimiento de la paz interna, imposición de su voluntad en todo su territorio, cumplimiento de las leyes estatales y promoción. Estos temas se exploran en relación con el Imperio del Antiguo Egipto, los Micenas, el Imperio Romano Occidental y los Mayas. Todos exhiben, en diversos grados, debilidades en el cumplimiento de las condiciones antes mencionadas necesarias para la estabilidad.
